Drug Paraphernalia

In New Jersey, N.J.S. 2C:36-2 makes it a disorderly persons offense to use or to possess with the intent to use any drug paraphernalia.  Drug paraphernalia is any device that is used to plant, propagate, cultivate, grow, harvest, manufacture, compound, convert, produce, process, prepare, test, analyze, pack, repack, store, contain, conceal, ingest, inhale, or otherwise introduce into the human body a controlled dangerous substance.  This includes items such as kits used to manufacture or grow drugs, scales used to measure drugs, balloons or envelopes used to package drugs, pipes, bowls, bongs, roach clips, wrapping paper, etc. 

One of the main tools used by police to make a case that a particular item constitutes drug paraphernalia is statements made by the owner of the item concerning its use.  Therefore, if your are accused of possessing drug paraphernalia, it is very important to assert your constitutional right to remain silent and not to make any statements to the police.  In addition, if the police can show that you intended to distribute the alleged drug paraphernalia, you can be charged with a fourth degree crime under N.J.S. 2C:36-3.
